  • Attorney Rush has successfully terminated or substantially reduced his clients’ alimony/support obligations in various post-judgment applications in both New Jersey and Pennsylvania.
    • 2021 - Attorney Rush successfully litigated a highly disputed post-judgment matter in Hunterdon County (NJ) where he obtained a Court Order terminating his client’s substantial remaining alimony obligation due to the ex-spouse’s cohabitation, saving his client more than $440,000.
    • 2019 - Attorney Rush successfully litigated a highly disputed post-judgment matter in Morris County (NJ) where he obtained a Court Order terminating his client’s remaining long-term alimony obligation due to the ex-spouse’s cohabitation saving his client more than $208,000. The cohabitating ex-spouse was also required to reimburse Attorney Rush’s client for $24,000 in alimony overpayments previously paid.
    • 2019 - Attorney Rush successfully litigated a Hunterdon County (NJ) case where he obtained a Court Order terminating his client’s alimony obligation due to changed circumstances and substantially reducing the client’s child support obligation by more than 60% due to the client’s decreased income.
    • 2016 - Attorney Rush obtained a Court Order in a Pennsylvania case terminating his client’s 6+ year alimony obligation due to the ex-spouse’s cohabitation less than 1 year after the Divorce Decree was entered.
  • 2018 - Attorney Rush negotiated a high-net worth divorce settlement agreement in a 30+ year marriage involving a client who earned more than $1.6 million dollars per year and a non-working spouse. Attorney Rush successfully limited the client’s alimony obligation to a modest, one-time buyout representing less than 13% of the client’s annual income. Attorney Rush’s client was also able to retain the marital home, 50% of the retirement benefits, and 75% of her executive stock options/restricted stock units worth more than $3.0 Million combined.
  • 2018 - Attorney Rush successfully litigated a complex divorce matter in Hunterdon County (NJ) where he was able to set aside the unreasonable terms of a pre-nuptial agreement that would have left his client with no alimony and zero interest in the spouse’s retirement benefits.  Attorney Rush successfully argued that the pre-nuptial agreement was invalid because it failed to provide full and fair disclosure of the parties’ income and assets, the terms were unconscionable, and client did not sign it voluntarily due to her limited ability to read/understand the English language.  As a result, Attorney Rush was instead able to obtain substantial alimony and child support awards as well as an immediate lump sum payment of $190,000 for the client.
  •  Attorney Rush has successfully litigated several custody relocation matters in both New Jersey and Pennsylvania, representing clients in applications both requesting and opposing relocation.
    • 2021 - Attorney Rush obtained a Court Order in a Warren County (NJ) custody case permitting his client to relocate with the child to Florida.

    • 2018 - Attorney Rush successfully litigated a 3+ day plenary hearing in an Essex County (NJ) custody case wherein he obtained a Court Order permitting his client to relocate with the child to Pennsylvania.
    • 2018 - Attorney Rush successfully represented a client opposing a custody relocation request in a Hunterdon County (NJ) case and obtained a Court Order denying the mother’s request to relocate with the children to Virginia in favor of the client and instead awarding the client increased parenting time.
    • 2012 - Attorney Rush obtained a Court Order in a Pennsylvania custody case permitting his client to relocate with the children to Berks County, Pennsylvania.
    • 2011- Attorney Rush obtained a Court Order in a Pennsylvania custody case permitting his client to relocate with the children to New Jersey.
  • Custody matters - Attorney Rush has obtained numerous judgments in both New Jersey and Pennsylvania awarding or transferring primary custody of children to his clients while also prohibiting various parental alienation acts. Attorney Rush has also obtained numerous Court Orders in custody matters addressing serious substance abuse and/or mental health issues and compelling opposing parties to undergo significant evaluations and treatment before exercising further (supervised) visitation rights in many cases.
  • 2017 - Attorney Rush successfully litigated a 9-day plenary hearing in a child dependency case for a newly-identified father fighting for the opportunity to have visitation with an 8 year old girl who he never knew was his daughter.  Despite vehement opposition from the attorney general’s office, the State’s experts, caseworkers, the law guardian, and foster parents, Attorney Rush successfully obtained a Court Order awarding the client visitation with his daughter.  Approximately 6 months later, the client was ultimately awarded sole legal and physical custody of the child.
  • 2016 - Attorney Rush successfully litigated a difficult interstate custody case that originated in New Jersey and was later transferred to Pennsylvania where he ultimately obtained a Court Order transferring primary physical custody of a 9-year old child to the client.
  •  2015 - Attorney Rush successfully obtained a Court Order in another Pennsylvania custody case transferring primary physical custody of an 11-year old child to a foster father client located in South Carolina away from the child’s mother in Pennsylvania.
  • 2012 - Attorney Rush successfully negotiated a marital settlement agreement in a New Jersey divorce matter whereby his client’s child support obligation to his ex-spouse was completely terminated in exchange for his client assuming a greater responsibility of the marital debt and the children’s college expenses.
